Terms and Conditions of Using GPHQ Discussion Boards and Secure Areas
Discussion boards & secure areas provided on https://gphq.com.au are subject to the following terms and conditions (“Terms and Conditions”). By entering into or using discussion boards & secure areas, the User agrees to accept these Terms and Conditions.
General Liability Notice
The open and real-time nature of the discussion forums makes it impossible for the GPHQ Pty Ltd to vouch for the validity or honesty of posts from individual members. We are not responsible for any messages posted, nor the consequences of reading them. The views expressed in the messages within the forums are those of the authors, who accept total responsibility for the content of their posts. If the User finds any posts in these forums to be offensive or objectionable, please contact the Website administrator at admin@gphq.com.au or click the ‘Report this Post’ link at the bottom of the post. If we determine that removal of a post or posts is necessary, we will make reasonable efforts to do so in a timely manner.
GPHQ will not be liable for any consequences or losses whatsoever that allegedly flow from the removal or decision not to remove a post on the website.
The intention of the GPHQ discussion boards is to facilitate interactions between professionals. We require all Users to respect each other’s opinions and conduct all discussions in a collegiate and mutually respectful manner.
Complaints
If the User finds any posts in these forums to be offensive or objectionable, please contact GPHQ admin@gphq.com.au or click the Report this Post link at the bottom of the post. If we determine that removal of a post or posts is necessary, we will make reasonable efforts to do so in a timely manner.
If a post is reported or if the moderators notice an objectionable post, the post or part of the post will be removed and replaced with the text [content removed by moderator].
General
Access to discussion boards is provided by GPHQ with a view to facilitating communication between professionals. The User should be mindful of this and the language used on discussion boards should reflect the professional nature of the interaction. GPHQ Pty Ltd is not liable for the content posted on the discussion boards and secure areas.
Each GPHQ discussion board group is autonomous and responsible for the content of their messages.
GPHQ Pty Ltd is under no obligation to monitor discussion boards but it may choose to do so. GPHQ Pty Ltd also reserves the right to remove any content or material at its sole discretion at any time without notice.
Discussion boards and secure areas can only be used to fulfil the stated objectives of each group. Use of https://gphq.com.au for commercial purposes or to obtain financial gain is strictly prohibited. https://gphq.com.au may not be used to send chain letters, junk mail, spam, solicitations (commercial or non-commercial) or bulk communications of any kind unless the recipient has given specific permission to be included in such a list.
GPHQ Pty Ltd may at any time, and without prior or post warning, delete messages or close discussions on discussion boards. GPHQ Pty Ltd also reserves the right, at its sole discretion, to modify or discontinue discussion boards or any portion thereof at any time without notice to the Users.
GPHQ Pty Ltd reserves the right to deny access to any individual who contravenes these terms and conditions. In the event that GPHQ Pty Ltd determines that a User has violated the terms and conditions of use, GPHQ Pty Ltd may at its sole discretion and without notice terminate the User’s access to the discussion boards. GPHQ Pty Ltd reserves its right to take further action as a result of violation of the Terms and Conditions.
Users have the choice of displaying either their name or their Username beside their posts.
Liability on the part of GPHQ Pty Ltd is excluded in relation to the content of any 3rd party websites which may be linked from the GPHQ discussion boards.
User Conduct and User Content
The User agrees to not use the discussion board and secure areas provided on https://gphq.com.au to:
Upload, post or otherwise transmit any material that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libellous, invasive of another’s privacy, hateful, or racially, ethnically or otherwise objectionable;
Impersonate any person or entity, including, but not limited to, a GPHQ official, forum leader, guide or host, or falsely state or otherwise misrepresent an affiliation with a person or entity;
Take screenshots of material or content on https://gphq.com.au and sharing this with others who are not registered GP users withhttps://gphq.com.au. Discuss other users comments without their permission;
Forge headers or otherwise manipulate identifiers in order to disguise the origin of any material transmitted through the discussion board and secure areas or develop restricted or password-only access pages, or hidden pages or images (those not linked to from another accessible page);
Upload, post or otherwise transmit any material that the User does not have a right to transmit under any law or contractual or fiduciary relationship (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under non-disclosure agreements);
Upload, post or otherwise transmit any material that infringes any patent, trademark, trade secret, copyright or other proprietary right of any party;
Upload, post or otherwise transmit any unsolicited or unauthorised advertising, promotional materials, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” or any other form of solicitation;
Upload, post or otherwise transmit any material that contains software viruses or any other computer code, files or programmes designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
Disrupt the normal flow of dialogue, cause a screen to “scroll” faster than other Users of the discussion board and secure areas are able to type, or otherwise act in a manner that negatively affects other Users’ ability to engage in real time exchanges;
Interfere with or disrupt the discussion board and secure areas or servers or networks connected to the discussion board and secure areas, or disobey any requirements, procedures, policies or regulations of networks connected to the discussion board and secure areas;
Intentionally or unintentionally violate any applicable local, state, national or international law or regulation;
“Stalk” or otherwise harass another User;
Collect or store personal data about other Users;
Promote or provide instructional information about illegal activities, promote physical harm or injury against any group or individual, or promote any act of cruelty to animals;
Attempt to gain unauthorised access to any GPHQ Pty Ltd website or service, other User accounts, computer systems or networks connected to any GPHQ Pty Ltd website or service, through hacking, password mining or any other means;
Create a false identity for the purpose of misleading others; and
Negative commentary on any 3rd party organisation.
The User understands that all content/material submitted by any other User is the sole responsibility of the User from which the content/material originated. GPHQ Pty Ltd has no liability in respect of any User or content submitted by any User.
The User accepts and agrees that if the User posts User Content on the website or views Content posted by other Users, the User is doing so at his or her own discretion and risk, and GPHQ Pty Ltd has no responsibility for the accuracy, integrity or quality of any such User Content or Content submitted by other Users. The User further accepts and agrees that the views expressed by the User in any Content submitted by the User, or any other Content submitted by other Users, do not necessarily reflect the views of GPHQ Pty Ltd. The User accepts and agrees that GPHQ Pty Ltd has no obligation to pre-moderate, review or monitor any Content posted by the User or any other Users on the Site.

The User’s use of this Website is entirely at the User’s own risk. All information provided on the Website is for informational purposes only. GPHQ Pty Ltd cannot fully guarantee the accuracy of the content and it by no means constitutes fully accurate medical, legal or financial advice. We have put measures in place, including vetting, to keep this a private Website but we cannot guarantee that all information submitted to the Website is fully confidential. It is important that Users keep this in mind when seeking information from colleagues on the Website relating to patient care, particularly in the discussion forum. The directory listings are to assist with referral and are by no means an endorsement of the individual specialists. If a User selects a medical or healthcare professional through the Website, the User does so at the User’s own risk. It is GPHQ’s aim that the specialist directory is up to date and comprehensive. This Website does not engage in popularity ranking of specialists and is not a referral service. This Website provides information that can assist with the referral process. Any Specialist, as defined by Section 3 of the Health Insurance Act 1973 (Cth), can be listed in the GPHQ directory as long as they are currently registered with the Australian Health Practitioner Regulation Agency. In some cases, the Content may include the views or recommendations of third parties, which do not necessarily reflect GPHQ Pty Ltd’s views. The User acknowledges that it is their sole responsibility to carry out their own enquiries and seek their own advice before relying on any information posted on the GPHQ website. GPHQ in no way warrants that the information posted on the website is correct and will not, in any circumstances, be liable for any consequences from or loss whatsoever that allegedly flow from relying on the information posted on the GPHQ website.
Indemnification
The User agrees to indemnify, defend (at GPHQ Pty Ltd’s request), and hold GPHQ Pty Ltd, its affiliates, officers and employees, harmless from any claim or demand, including reasonable legal expenses, made or brought by any User or third party due to or arising out of:
The User’s use of the discussion boards and secure areas or any part thereof;
The violation of these terms and conditions or any provision therein by the User;
The publication of any Content; and
The viewing of any Content by any third party.
ACKNOWLEDGEMENT OF THESE TERMS AND CONDITIONS
The User hereby acknowledges receipt of these Terms & Conditions, and that they are legally binding and presently enforceable. The User further acknowledges that they have had the opportunity of obtaining independent legal advice and that they understand the Terms and Conditions outlined above.
